Should you wish to register .nyc names with us or transfer .nyc names to our management, the Registry Operator, The City of New York by and through the New York City Department of Information Technology and Telecommunications, imposes certain conditions. As set out in our Terms and Conditions, by placing an order with us you unconditionally agree to be bound by these conditions as follows:

  1. Registrant agrees to abide by all ICANN Requirements including, without limitation, standards, policies, procedures, and practices for which Registry Operator has monitoring responsibility in accordance with the Registry Agreement or other arrangement with ICANN.
  2. Registrant agrees to abide by all Operational standards, policies, procedures, and practices for the Registry TLD as set forth in the Registry Agreement and as established from time to time by Registry Operator in a non-arbitrary manner and applicable to all registrars (“Operational Requirements”), including affiliates of Registry Operator, and consistent with ICANN’s standards, policies, procedures, and practices and Registry Operator’s Registry Agreement with ICANN, as applicable, upon Registry Operator’s notification to Registrar of the establishment of those terms and conditions. Additional or revised Registry Operator operational standards, policies, procedures, and practices for the Registry TLD shall be effective upon thirty (30) days’ notice by Registry Operator to Registrar.
  3. Registrant agrees to comply with any and all applicable national, state, or local law, regulation, or court order in relation to its Registration.
  4. Registrant acknowledges that Registrant must expressly agree to the price of a domain name prior to Registration and acknowledges that the price for the creation of a domain name may be greater than or less than the price for the renewal of that domain name.
  5. Registrant represents and warrants that it will provide current, complete, and accurate information in connection with its Registration, and that Registrant will correct and update this information to ensure that it remains current, complete, and accurate throughout the term of any resulting Registration or Reservation. The Registrant acknowledges that the Registry Operator reserves the right to immediately deny, cancel, terminate, suspend, lock, or transfer any Registration if it determines, in its sole discretion, that the information is materially inaccurate;
  6. Registrant consents to the collection, use, processing, and/or disclosure of Registrant’s personal information in the United States and in accordance with the Registry Operator’s Privacy Policy posted on the Registry Operator’s website at www.nic.nyc;
  7. Registrant acknowledges and agrees to be bound by the terms and conditions of the following documents, as they may be amended from time to time:
    1. The Uniform Domain Name Dispute Resolution Policy (“UDRP”), available at http://www.icann.org/en/help/dndr/udrp/policy;
    2. The Uniform Rapid Suspension Procedure and Rules (“URS), available at http://newgtlds.icann.org/en/announcements-and-media/announcement-05mar13-en; and
    3. The Transfer Dispute Resolution Policy, available at http://www.icann.org/en/help/dndr/tdrp.
  8. Registrant agrees to submit to proceedings commenced under the UDRP, and the URS and further agrees to abide by the final outcome of any of those processes, subject to any appeal rights provided in those processes or the law, and Registrant hereby releases the Registry Operator, its affiliates and service providers from any and all direct or indirect liability associated with such dispute resolution processes.
  9. Registrant acknowledges and agrees to abide by all .Registry Operator Policies (including but not limited to the Registry Operator’s nyc Nexus Policy and Acceptable Use Policy) set forth on the Registry Operator website at www.nic.nyc and Registrant acknowledges and agrees that the Registry Operator Policies may be modified by the Registry Operator, and agrees to comply with any such changes in the time period specified for compliance;
  1. Registrant acknowledges and agrees that the Registry Operator reserves the right to disqualify it or its agents from making or maintaining any Registrations or Reservations in the .nyc registry if the Registrant is found to have repeatedly engaged in abusive registrations, in the Registry Operator’s sole discretion;
  2. Registrant agrees that Registry Operator reserves the right to deny, cancel or transfer any registration or transaction, or place any domain name(s) on registry lock, hold or similar status, that it deems necessary, in its discretion if it reasonably concludes that the domain name is being used in a manner that appears to:
    1. conflict with this Policy;
    2. threaten the stability, integrity or security of the .nyc TLD, the DNS or the global Internet, or any of its registrar partners; and/or
    3. put the safety and security of any registrant or user at risk. The process also allows the Registry to take proactive measures to detect and prevent criminal conduct or cybersecurity threats.
  3. The Registrant acknowledges and agrees that the. Registry Operator reserves the right, in its sole discretion, to take any administrative and operational actions necessary, including the use of computer forensics and information security technological services, among other things, in order to implement the Acceptable Use Policy. In addition, Registry Operator reserves the right to deny, cancel, or transfer any registration or transaction, or place any domain name(s) on registry lock, hold or similar status, that it deems necessary, in its discretion:
    1. to enforce .NYC Policies, as amended from time to time;
    2. to protect the integrity and stability of the Internet, Registry Operator, its operations, and the .nyc registry;
    3. to comply with any applicable law, regulation, holding, order, or decision issued by a court, administrative authority, or dispute resolution service provider with jurisdiction over the Registry Operator or you;
    4. to establish, assert, or defend the legal rights of the Registry Operator or a third party, or to avoid any liability, civil or criminal, on the part of the .NYC Registry Operator as well as its affiliates, subsidiaries, owners, officers, directors, representatives, employees, contractors, and stockholders;
    5. to respond to violations of this policy;
    6. to correct mistakes made by the Registry Operator or any Registrar in connection with a Registration or Reservation;
    7. or as otherwise provided herein.
  4. The Registrant agrees to indemnify to the maximum extent permitted by law, defend and hold harmless the Registry Operator, its affiliates and service providers, and each of their respective directors, owners, officers, employees, contractors, and agents, from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses, arising out of or relating to the Registrant’s use, operation, Registration of any name and/or website in the .nyc registry.
  5. The Registrant acknowledges and accepts the Registry Operator reserves the right to modify, change, or discontinue any aspect of its services, agreements, or it’s Acceptable Use Policy.
  6. Registrant shall not participate in distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity that is contrary to applicable law; and acknowledges consequences for such activities include suspension or deletion of the Registration
  7. Registrant acknowledges and agrees that the Registry Operator reserves the right to take immediate action to remove orphan glue records (as defined at http://www.icann.org/en/committees/security/sac048.pdf) when provided with evidence in written form that such records are present in connection with malicious conduct.
