Rightside registry was acquired by Donuts in July 2017. Registrants of what were formerly Rightside TLDs are bound by the Rightside Registration Terms and Conditions , as amended from time to time, as well as Rightside policies as amended from time to time.
As set out in our terms and conditions, by placing an order with us for Rightside TLDs you unconditionally agree to be bound by these conditions as follows:
1. Registrant agrees to abide by all the Registration Terms & Conditions and any additional registration requirements which may be added, from time to time, in order to comply with new ICANN policies or to comply with certain Public Interest Commitments (PICs) applicable to specific Registry TLDs as part of the Registry Agreement, including but limited to ICANN’s Uniform Rapid Suspension System (“URS”).
2. Registrant warrants and represents that, by applying to register or reserve a domain name in a Registry TLD, neither Registrant’s registration nor Registrant’s use of the name will infringe the intellectual property or other rights of any third party or violate the Registry Operator’s Acceptable Use (Anti-Abuse) Policy. Registrant specifically acknowledges and agrees that the Registry Operator Policies may be modified by the Registry Operator, and agrees to comply with any such changes in the time period specified for compliance.
3. Registrant agrees to comply with all applicable ICANN requirements and policies found at www.icann.org/en/general/consensus-policies.htm.
4. Registrant agrees to comply with all applicable laws, including those that relate to privacy, data collection, consumer protection, fair lending, debt collection, organic farming, disclosure of date and financial disclosures.
5. Registrant will implement reasonable appropriate security measures commensurate with the offering of those services as defined by applicable law if Registrant should use a Registry TLD to collect and or maintain sensitive health and financial data.
6. Registrant shall not participate in distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity contrary to applicable law.
7. Registrant consents to collection and use of Registrant’s Personal Data during the registration process and for internal statistical analysis, provided that such analysis will not disclose individual and non-public Personal Data and such non-public Personal Data is only used for internal business purposes.
8. Registrant consents to the collection, use, processing, and/or disclosure of personal information in the United States and in accordance with the Registry Operator’s Privacy Policy, and if Registrant is submitting information from a country other than the country in which the Registry Operator servers are located, Registrant communications with the Registry Operator may result in the transfer of information (including Registrant’s membership account information) across international boundaries; Registrant consents to such transfer.
9. Registrant shall provide accurate contact information as well as comply with all applicable rules and laws (including those that relate to privacy, data collection, consumer protection, import/export of services, rendering of licensed professional services, and disclosure of data) and will correct and update this information to ensure that it remains current, complete, and accurate throughout the term of any resulting registration or reservation.
10. Registrant agrees to submit to proceedings commenced under ICANN’s Uniform Domain Name Dispute Resolution Policy (“UDRP”), and URS, each as described on the ICANN Website. Registrant further agrees to abide by the final outcome of any of those processes, subject to any appeal rights provided in those processes or the law, and you hereby release the Registry Operator, its affiliates and service providers from any and all directly or indirect liability associated with such dispute resolution processes.
11. Registrant shall (within thirty (30) days of demand) indemnify, defend and hold harmless Registry Operator (by express reference), Registrar and their respective affiliates and subsidiaries, as well as each of their respective owners, directors, managers, officers, employees, contractors, service providers and agents from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses (including on appeal), arising out of or relating in any way to the Registrant’s domain name registration, including, without limitation, the use, registration, extension, renewal, deletion, and/or transfer thereof and/or the violation of any applicable terms or conditions governing the registration and shall not enter into any settlement or compromise of any such indemnifiable claim without Registrar’s or Registry Operator’s prior written consent. This indemnification obligation shall survive the termination or expiration of the terms and conditions between the Registrar and the Registrant.
12. Registrant acknowledges that Registry Operator is entitled to, at any time, verify:
Registrant agrees to fully comply and cooperate with Registry Operator in connection with such verification and furnish all requested documentation as Registry Operator may reasonably require to complete the verification.
13. Registrant shall allow Registry Operator to contact Registrant for purposes relating to compliance with Registry Operator’s Registry Policies and Registration Terms and Conditions and for the purpose of distributing important information regarding the use of Registry TLDs, preserving the integrity of the SRS, and for no other purposes.
14. Registrant acknowledges and agrees that the Registry Operator reserves the right, in its sole discretion, to disqualify Registrant or Registrant’s agents from making or maintaining any registrations or reservations in the Registry TLD if you are found to have repeatedly engaged in abusive registrations.
15. Registrant acknowledges and agree that the Registry Operator reserves the right to deny, cancel, terminate, suspend, lock, or transfer any registration that it deems necessary, in its discretion, in furtherance of the following:
16. In addition should Registrant choose to register one or more of these new generic top-level domain names, you must comply with the registration requirements as described below:
Registrants must provide to their Registrar administrative contact information, which must be kept up-to-date, for the notification of complaints or reports of registration abuse, as well as the contact details of the relevant regulatory, or industry self-regulatory, bodies in their main place of business and must possess any necessary authorisations, charters, licenses and/or other related credentials for participation in the sector associated with Highly-regulated TLDs and report any material changes to the Registrant’s authorisations, charters, licenses and/or other related credentials for participation in the sector associated with the Highly-regulated TLD.
Registrant must take steps to ensure against misrepresenting or falsely implying that the Registrant or its business is affiliated with, sponsored or endorsed by one or more country’s or government’s military forces if such affiliation, sponsorship or endorsement does not exist.
Registrant should be aware that under Australian Defence Regulation 1957, No. 16, individuals and businesses, who are subject to Australian law, are prohibited from using the words “Navy” and “Air Force” in connection with a trade or business. Consequently, Australian based Registrars are advised that it may be illegal to sell or distribute domain names under this law and selling or distributing domain names to consumers based in Australia may also be prohibited. Australian Registrars are advised to consult with their legal counsel prior to selling or distributing any .NAVY or .AIRFORCE domain name.
Registry Operator imposes the following obligations upon resellers of Registry Operator’s domain names:
1. Reseller shall comply with all the terms and conditions of this Registry-Registrar agreement and all of Registrar’s covenants, obligations, representations and warranties as set forth in this Registry-Registrar agreement.
2. Reseller shall indemnify, defend and hold harmless Registry Operator (by express reference or by reference to all registry operators) and its affiliates and subsidiaries, as well as their respective owners, directors, managers, officers, employees, representatives, agents, service providers and contractors from and against any and all claims, damages, liabilities, costs and expenses of any kind, including without limitation reasonable legal fees and expenses (including on appeal), arising out of or relating to:
Reseller shall not enter into any settlement or compromise of any such indemnifiable claim without Registry Operator’s prior written consent.
This indemnification obligation shall survive any termination or expiration of the Reseller Agreement and/or this Registry-Registrar Agreement. Reseller acknowledges that Registry Operator reserves the right upon written notice to require Registrar to terminate any Reseller’s right to provide registrar services with respect to the Registry TLDs if such Reseller fails to comply with the terms of this Registry-Registrar agreement (a “Reseller Breach”) and to take any measures Registry Operator deems necessary to prevent such Reseller from accessing the Registry System. Unless the nature of the Reseller Breach is such that it is incapable of being cured or the same breach has been committed previously by the same Reseller, Registry Operator’s notice shall provide a ten (10) day cure period.
